DMCA / Copyright Policy

Overview

ConvertIntoMP4 respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using our Service. This policy outlines the procedures for copyright owners to submit takedown notices and for users to file counter-notifications.

Important Note About Our Service

ConvertIntoMP4 is a file conversion tool. All uploaded files are automatically and permanently deleted within 2 hours. We do not host, store, index, or publicly display user-uploaded content. We have no knowledge of the contents of files uploaded by users. However, we take copyright infringement seriously and will act on valid DMCA notices related to any content processed through our Service.

Filing a DMCA Takedown Notice

If you believe that content accessible through ConvertIntoMP4 infringes your copyright, you may submit a written DMCA takedown notification to our designated agent. To be effective, your notification must include:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URLs, user account details, timestamps).
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Warning:Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

Counter-Notification Procedure

If you believe that material you uploaded was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or any judicial district in which ConvertIntoMP4 may be found if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and inform them that the removed material may be restored in 10-14 business days. If the copyright owner does not file a court action against you within that period, we may restore the material or cease disabling access to it.

Repeat Infringer Policy

In accordance with the DMCA, ConvertIntoMP4 maintains a policy for the termination of users who are repeat infringers:

  • First offense: We will remove or disable access to the allegedly infringing content and send a warning to the user.
  • Second offense:We will remove or disable access to the content, issue a final warning, and may temporarily suspend the user's account.
  • Third offense:We will permanently terminate the user's account without further notice. Terminated users are prohibited from creating new accounts.

We reserve the right to terminate any account at any time if we believe, in our sole discretion, that the user is engaging in repeated or egregious copyright infringement, even if fewer than three notices have been received.

Good Faith Protections

ConvertIntoMP4 processes files on behalf of users and has no practical ability to inspect the contents of every file uploaded for conversion. We rely on the DMCA notice-and-takedown framework to address claims of infringement. We also employ automated virus scanning (ClamAV) and content type validation, but these measures are designed for malware detection and format verification, not copyright analysis.
